By downloading, installing, or using Ovaly, you confirm that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, please do not use the app.

Ovaly is a free period and cycle tracking app that runs entirely on your iPhone. It calculates predictions and insights locally on your device using the data you choose to enter. Ovaly is offered without an account, without a cloud backend, without advertising and without subscriptions. Ovaly is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Ovaly is intended for users aged 16 and older. By using the app you confirm that you meet this age requirement. The app is not designed for, or directed at, users under 16. If you are a parent or guardian and believe a younger user has installed Ovaly, please uninstall it to remove all locally stored data.

You are responsible for the accuracy of the information you enter into Ovaly. The quality of any prediction depends directly on the data you provide. You agree not to rely on Ovaly for medical decisions, contraception, fertility treatment or any other purpose with potentially serious consequences for your health, and to consult a healthcare professional for any such decision.

The Ovaly application, its source code, design, branding, content, copy, illustrations and all related materials are the intellectual property of RKI-Benito Handels GmbH and are protected by Austrian, European and international copyright and trademark law. You receive a personal, non-exclusive, non-transferable and revocable licence to use Ovaly on devices you own or control, solely for your personal, non-commercial cycle-tracking use. Any other use, including reverse engineering, redistribution, sublicensing or commercial exploitation, is prohibited unless expressly permitted in writing.

Ovaly is provided "as is" and "as available", without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of predictions, or non-infringement. To the fullest extent permitted by Austrian law, RKI-Benito Handels GmbH shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of, or inability to use, Ovaly — including, without limitation, any reliance on cycle, fertility or ovulation predictions, or any health-related decision based on the app. Mandatory statutory liability (in particular for personal injury caused by gross negligence or intent, and liability under the Austrian Product Liability Act) remains unaffected.

You may stop using Ovaly at any time. You can delete all of your data with one tap from Settings → Reset All Data, or by uninstalling Ovaly from your iPhone, which permanently removes every piece of cycle data the app has stored locally. Because Ovaly works without an account, no further action on the part of RKI-Benito Handels GmbH is required.

We may update these Terms of Use as the app evolves or as legal requirements change. Material changes will be communicated through a future app update and reflected in the effective date above. Your continued use of Ovaly after the new effective date constitutes acceptance of the updated Terms.

These Terms of Use are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is the competent court in Graz, Austria, to the extent permitted by law. Mandatory consumer-protection rules in your country of residence remain unaffected.
